The Alabama Supreme Court has ordered a Baldwin County judge to dismiss a negligence claim against Fairhope over the city’s rejection of two proposed townhome apartment developments, but the developer’s broader legal fight with the city is not over.
The court ruled Friday that Fairhope and its Planning Commission are immune from a claim by 68V BTR Holdings seeking money damages over the rejection of its Skyline Village and Gables on Lawrence projects.
